Financial Compensation for the Death of a Foreign Soldier or Volunteer in Ukraine
We provide comprehensive legal support for foreign relatives of deceased soldiers and volunteers who fought on Ukraine’s side. Our lawyers offer expert assistance in obtaining state compensation for combat-related deaths and associated benefits.
Family members — spouses, children, parents, or relatives who lived together with the deceased — are entitled to a one-time state payment of up to 15,000,000 UAH (approximately €350,000). The compensation is divided equally among all eligible family members.
Legal Services for Obtaining Compensation for the Death of a Foreign Soldier in Ukraine
- Verification of Eligibility. Determining relatives’ eligibility for compensation. Establishing the fact of death and service status. Obtaining a death certificate or a court declaration of death.
- Document Collection and Preparation. Gathering, preparing, and legalizing documents. Preparing the compensation application, notarized translations of passports and relationship documents, obtaining a Ukrainian tax number, and gathering evidence that the death occurred during service or combat. Translation and notarization services are billed separately.
- Application Submission. Filing the compensation application with authorized authorities (Ministry of Defense divisions), reviewing materials, and obtaining a decision. The commission issues a decision within 30 days, which must be approved by the Minister of Defense. In case of refusal, judicial appeal is possible.
- Payment Processing. Assistance in obtaining the payment after approval — including advance payments and subsequent installments, depending on the case.
Under Ukrainian law, compensation is available to the spouse, children, and parents of the deceased, as well as other family members who lived together, shared a household, and had mutual rights and responsibilities. There are two phases of payment for compensation to families of deceased foreign soldiers.
Key Conditions for Receiving Compensation
- Confirmation of Death: The foreign national must have died while in service or during combat operations in Ukraine, or been declared dead by a court.
- Verification of Legal Status: Confirmation that the deceased was a soldier or volunteer (officially serving in the Armed Forces of Ukraine or a recognized volunteer formation). The death must be directly related to military duties or combat. Compensation may be denied if death occurred due to misconduct (e.g., alcohol intoxication).
- Authorized Decision: Payment is made following a decision by the authorized authority after all documentation is provided.
- Non-Combat Deaths: If the death was unrelated to combat, the compensation amount and procedure may differ.
Compensation is paid in Ukrainian hryvnias (UAH) to a Ukrainian bank account. Transfers abroad are possible with supporting documents but may be subject to currency control restrictions. Foreign relatives can receive funds through a Ukrainian account or via an authorized representative in Ukraine.
Procedure and Workflow for Compensation Cases
- Initial Consultation & Document Review. Verification of service status (Armed Forces, International Legion, or volunteer unit), analysis of contracts, certificates, and death documentation.
- Legal Dossier Preparation. Compiling required documents, preparing notarized translations, and legalizing foreign documents (apostille or consular). Drafting powers of attorney for family members abroad. Correspondence with the Ministry of Defense and related authorities.
- Filing the Application. Submitting the official package, tracking registration and review (average 30 days), responding to additional requests, and providing clarifications.
- Court Representation (if required). In case of denial, preparing and filing a claim in an administrative court, obtaining and enforcing the court decision.
- Payment Assistance. Helping to open a bank account in Ukraine or appoint a local representative, preparing documents for international transfers, and ensuring the actual receipt of funds.
A Ukrainian military lawyer conducts a full legal analysis of each case, prepares all necessary documents, files applications on behalf of the family, oversees the entire compensation process, and assists with payment receipt after approval.
