Main Divorce Procedures in Ukraine
Divorce in Ukraine may be handled by the civil registration authorities or the courts, depending on whether the spouses agree, whether they have children under 18 together and the other circumstances of the case. The applicable procedure is determined under Ukrainian law.
Divorce Through the Civil Registry Office (DRACS)
Ukraine's civil registration offices (DRACS) handle administrative divorces in cases permitted by law. This simplified procedure applies where both spouses agree to divorce and there are no minor children. It is an administrative process that does not require court proceedings and is generally the quickest way to end a marriage in Ukraine.
In circumstances specified by law, a civil registration authority may dissolve a marriage on the application of one spouse, particularly where the other spouse has been declared missing or legally incapacitated by a court. In other cases, the appropriate procedure depends on the facts and the requirements of Ukrainian law.
Divorce by Mutual Consent Through the Courts
Where spouses have minor children together and both agree to divorce, they may submit a joint application to the court together with the documents required by law. The court checks compliance with legal requirements and safeguards the children's rights before issuing its decision.
Contested Divorce Without the Other Spouse's Consent
If one spouse does not agree to the divorce or refuses to participate, the matter is dealt with by the court. A court may dissolve the marriage even without the other spouse's consent.
Divorce Involving Children and Property Disputes
Where spouses have minor children or disagree over property division, child maintenance or a child's living arrangements, the proceedings can become more complex and require a carefully considered legal strategy.
These procedures cover both uncontested and contested divorces in Ukraine, including cases with international or cross-border elements.
International Divorce Cases
Divorce involving foreign nationals or spouses living abroad requires careful consideration of jurisdiction, document legalisation and certified translations, where required.
In many cases, the proceedings can be handled remotely through a legal representative.

Which Court Has Jurisdiction Over a Divorce in Ukraine?
As a general rule, a divorce claim is filed with the court for the defendant's registered place of residence or stay. In cases provided for by law, it may instead be filed at the claimant's registered place of residence or stay, including where the claimant has young or minor children in their care or cannot reasonably travel to the defendant's location because of health problems or other valid reasons.
By agreement between the spouses, the case may also be heard at the registered place of residence or stay of either spouse.
Legal Consequences of Divorce in Ukraine
The legal consequences depend on whether the spouses have children, property and financial obligations towards one another.
Divorce ends the marital relationship for the future, but it does not in itself terminate joint ownership of property acquired during the marriage or discharge existing obligations. Property division, child maintenance and financial support for a former spouse may need to be resolved separately. Legal advice can help identify the necessary steps and protect the client's interests.
Division of Property
Assets and real estate acquired during the marriage are generally treated as jointly owned marital property and may be divided by agreement or through court proceedings.
Child Residence and Living Arrangements
After divorce, parents may agree on where their child will live and how each parent will participate in the child's upbringing. If they cannot agree, these matters are resolved through the procedure prescribed by law, taking account of the child's age, best interests and other relevant circumstances. Divorce itself does not restrict parental rights or responsibilities.
Child Maintenance (Child Support)
Parents are required to support their minor children. The amount of child maintenance may be agreed between the parents or determined by a court.
Spousal Maintenance
In circumstances specified by law, one spouse may be entitled to financial maintenance after divorce, subject to the statutory conditions and the facts of the case.
Surname After Divorce
Following divorce, a person may retain the surname adopted upon marriage or revert to their previous surname.
Legal Effect of the Court Judgment
Once a divorce judgment becomes final and legally effective, the marriage is dissolved. The judgment serves as evidence of the divorce and may be used to obtain the necessary documents in Ukraine and abroad, subject to the requirements of the relevant country.
How Long Does Divorce Take in Ukraine?
The length of the process depends on the procedure used, the circumstances of the case and the court's workload.
- Divorce through the civil registration authorities: generally takes effect one month after the joint application is submitted.
- Divorce through the courts: the timeframe depends on the case, procedural steps and whether the other spouse must be formally notified.
- International divorce: may take longer because documents, translations and cross-border service of notice may be required.
Documents Required for Divorce in Ukraine
The documents needed depend on the type of divorce and the circumstances of the case.
- Passport or other identity document
- Marriage certificate
- Documents relating to children (if applicable)
- Proof of residence or registration
- Documents establishing the representative's authority (if required)
Annulment of Marriage
A marriage may be declared invalid if it was fictitious or entered into in breach of legal requirements. Annulment is a separate legal procedure with different consequences from divorce.
Legal Fees for Divorce in Ukraine
Fees are assessed individually and depend on the nature and complexity of the case, the work required and any urgency.
For an initial assessment, briefly describe your situation and specify whether you have minor children together, whether the other spouse agrees to divorce and the country where each spouse lives.
